It is true that in McCormick v. Robinson, 139 Minn. 483 , , following Bond v. P. R. 3, § 7845, provides that, “at the time of issuing the summons” or at any time thereafter, a plaintiff may have the assistance of the writ, then adds: “The action must be begun as prescribed in § 7707 not later than 60 days after issuance of the writ.” That the action was already begun when the writ issued, within the purview-of section 7707, is so clearly determined by Bond v. Pennsylvania R. Co. 124 Minn. 195 , , and McCormick v. Robinson, 139 Minn. 483 , , that no further comment is needed.

We gave this statute careful consideration in Bond v. Pennsylvania R. Co. 124 Minn. 195 , , and reached the conclusion that where the provisions of the statute were complied with, the action was deemed begun when the summons was delivered to the proper officer for service, not merely for the purpose of avoiding the bar of the statute of limitations, but for all purposes.
