Since the existence of an implied warranty is a question of law and does not arise out of a contract *67 or the intention of the parties (Bekkevold v. Potts, 173 Minn. 87, 89 , , 59 A. L. R. 1164), the trial court’s “finding of fact” to the effect that the Dworsky Agency warranted that it would deliver a policy complying with the laws of this state is a mere conclusion of law and is not binding upon this court.
