Notwithstanding the rule in civil cases that degrees of negligence are not recognized in this state (see, Peet v. Roth Hotel Co. 191 Minn. 151 , ; Lauritsen v. American Bridge Co. 87 Minn. 518 , ), it is our plain duty to recognize and give effect to degrees of negligence where a statute adopts them as a basis for fixing criminal responsibility.
