The Minnesota Supreme Court, interpreting the underinsured motorist law then in force, that “it is only to the extent that the [UIM] coverage exceeds the tortfeasor’s insurance that the tortfeasor is underinsured.” In other words, the injured person could recover from the underinsurer the difference between the UIM limits and the tort-feasor’s primary coverage limits.
