While the courts have indicated that a board should not merely “rubber stamp” the findings of a hearing examiner, City of Moorhead v. Minnesota Public Utilities Comm’n, nevertheless, the board should not take the ALJ’s findings lightly: A hearing examiner’s report and recommendations should not be summarily rejected without reasons.
